BTS Event Rentals - Rental Agreement

PAYMENT

  1. All Services require a 50% deposit to secure date, equipment, and staff. Set up and Tear Down must be agreed upon and paid in advance. If no set up or tear down is ordered, the LESSEE/PURCHASER is responsible for setting up all of the equipment and packing it back up to be picked up in the same condition as it was delivered (cables wrapped, crates packed, speakers off stands, loaded out. 
  2. Deposit is non-refundable.Deposits may be transferred to a rescheduled date should production be cancelled. Rescheduled dates and cancellations require 168 hour or 7 days notice with confirmation and contact with BTS Event Rentals. 
  3. For production service, Full payment balance is required and due upon scheduled LOAD IN TIME. For Delivery, Full payment balance is required and due upon scheduled DELIVERY IN TIME. 
  4. BTS Event Rentals has the right and authority to terminate services at any time if PAYMENT TERMS are not adhered to. 
  5. A past due charge of 10% monthly or 2.5% per week will be accrued daily beginning the day after the event and based on the total balance due. Any items not returned on-time or without pre-arranging additional rental time will be assessed at the regular daily or weekly rental rate for the duration the equipment is not in the possession of BTS Event Rentals. LESSEE/PURCHASER can neither lend nor sub-let the item without BTS Event Rentals express written authorization. 

RESPONSIBILITY AND LIABILITY 

  1. LESSEE/PURCHASER is responsible and liable for any theft or damages to equipment while servicing production and/or in LESSEE possession. 
  2. The LESSEE/PURCHASER agrees that BTS Event Rentals is not liable for any personal injuries or other damage sustained by the sale or rental of this property while using the equipment by this rental/purchase agreement. LESSEE/PURCHASER agrees BTS Event Rentals is not responsible for accidents or injuries caused directly or indirectly in the use of the rental items, including but not limited to: wage loss, present and future performing contracts, and bodily/personal/property damage incurred to the renter or user of said items due to misuse or malfunction of said items. 
  3. The LESSEE/PURCHASER further agrees to keep BTS Event Rentals and its production staff and interests free and harmless from any loss, damage, responsibility or obligation sustained by the LESSEE/PURCHASER, or any other person due to use of this equipment. 
  4. The LESSEE/PURCHASER agrees that any costs, claims or attorney’s fees, or liability resulting from or arising out of the use of the herein described equipment, directly or indirectly, will be paid by the LESSEE/PURCHASER regardless of the claimant or claimants who institute the action; LESSEE/PURCHASER further agrees that if action be instituted to enforce any provision of this agreement he will pay such sums as the court may fix as court and attorney’s fees. 


RETURNS OF EQUIPMENTS

  1. LESSEE/PURCHASER agrees to return rental equipment to BTS Event Rentals in good working order, upon demand, and if not returned within twenty- four hours, BTS Event Rentals may, without prior consent, or court order, enter upon LESSEE’S premises to repossess all, or part, of its equipment whenever it deems necessary. BTS Event Rentals may inspect equipment at any time, observe or remove same from any premises, and LESSEE shall not remove said equipment from job location at any time without written authority from BTS Event Rentals.
  2. LESSEE/PURCHASER agrees that the DAILY RATE shall apply where equipment is not returned at time agreed, and ADDED CHARGES will be made for each day, or part thereof, that LESSEE keeps equipment after specified period. 
  3. All charges are based on the time the items are in the LESSEE/PURCHASER’s possession, whether in use or not. 
  4. In the event the LESSEE/PURCHASER fails to return said items at the agreed times or fails to abide by any of the other terms of this contract, BTS Event Rentals may retrieve the rented items without notice to the LESSEE/PURCHASER, and BTS Event Rentals is hereby released from all claims arising there from. 
  5. In the event of the LESSEE/PURCHASER not returning the rented Item, he or she will be liable to pay BTS Event Rentals the regular daily or weekly rental rate of equipment. 

DAMAGES OR LOSS

  1. In the event that the LESSEE/PURCHASER returns the equipment in a bad and/or poorly maintained condition, the LESSEE/PURCHASER will be liable to pay the cost of potential maintenance repair carried out by a professional specialist. This service provider will be chosen by BTS Event Rentals within a period of 10 working days, or, if need be, after formal notice is given by BTS Event Rentals. 
  2. LESSEE/PURCHASER agrees to pay promptly the replacement retail value for any equipment, which may be lost or returned in damaged condition within 10 business days of being invoiced. From the time the item(s) is received until it is returned, LESSEE/PURCHASER is responsible for it. If the item(s) are lost, stolen, or damaged under any circumstances while rented, regardless of fault, LESSEE/PURCHASER shall be responsible for all charges, including labor and parts or equipment replacement. This can include but is not limited to blown speakers (due to over-leveling), dropped microphones, as well as lost cables/power cords and broken stands. 
  3. LESSEE/PURCHASER agrees to insure said property against all risks of loss or damage in a sum of not less than the total aggregate equipment value or the actual current retail value of such equipment, with an insurance carrier acceptable to BTS Event Rentals and, at the option of BTS Event Rentals, to supply a certificate of insurance for same. 
  4. The LESSEE/PURCHASER has / will examine(d) said items upon pickup or delivery, judge the items to be in good condition and will return the items in as good condition as when received, ordinary wear and tear excepted. 
  5. LESSEE/PURCHASERs will pay promptly when due all charges which accrue because of this rental, including damage, theft or loss of said items. 
  6. LESSEE/PURCHASER hereby assumes the entire risk of loss, damage or destruction of equipment from any and every cause whatsoever commencing with delivery of said equipment to LESSEE/PURCHASER.

USE OF EQUIPMENT

  1. LESSEE/PURCHASER agrees to operate said equipment only in the manner for which it was intended. LESSEE/PURCHASER agrees not to attempt to make any repairs or alterations of any kind, if rental equipment becomes inoperative. 
  2. LESSEE/PURCHASER agrees not to use the equipment for any illegal purposes or in a manner that is contrary to its intended use, or moral and social standards. The LESSEE/PURCHASER will use, maintain and take care of the equipment in a careful and responsible manner. The LESSEE/PURCHASER will be held liable for any damages he/she causes to the rented equipment.

SET UP AND TEAR DOWN

  1. Set up and Tear Down must be agreed upon and paid in advance. If no set up or tear down is ordered, the LESSEE/PURCHASER is responsible for setting up all of the equipment and packing it back up to be picked up in the same condition as it was delivered (cables wrapped, crates packed, speakers off stands, loaded out.
  2. There is a 5-hour minimum on all calls. Certain technical positions are subject to a 10-hour minimum. The first 10 hours of a workday are billed at straight time (1x). After 10 hours of a workday are billed at overtime(1.5x). 

By executing this contract as a LESSEE/PURCHASER, he or she agrees that he or she is at least eighteen (18) years of age, that he or she has the authority to enter into this agreement and should he or she not have such authority, he or she personally accepts and assumes full responsibility and liability under the terms of this contact. 

This contract contains the entire agreement between the parties and no statement, promises, or inducements made by any party hereto, or agent or representative or either party hereto, which are not contained in this written contact, shall be valid or binding. 

This contract shall not be enlarged, modified, or altered except by both parties and endorsed hereon. This Agreement is the complete understanding between the parties and supersedes and replaces all previous agreements or representations both written and oral. LEESEE/PURCHASER have read and agree to the terms and conditions of this Agreement and do hereby set their hands.
